1. Who we are
EzeePC ("EzeePC", "we", "us") operates a Cape Town-based marketplace for pre-owned and refurbished computer equipment - laptops, desktops, monitors, servers, components and accessories. We are currently only operational in Cape Town, South Africa. By using this site you agree to these terms. If you don't agree, please don't use the site.
2. Direct listings vs. other sellers
Some listings are units EzeePC has sourced, tested and graded itself - these are sold directly by EzeePC and are backed by our grading process and the sale agreement provided with the unit. Other listings may be posted by independent registered users through their own account. For those listings, EzeePC provides the platform and facilitates contact (including via WhatsApp), but is not the seller, is not a party to that transaction, and does not guarantee the accuracy of a third party's listing, their title to the item, or their conduct. Deal with individual sellers at your own discretion, and use the same care you'd use with any private sale.
3. How buying works
There is no online checkout on this site - to buy something, you contact us (or the listing seller) directly on WhatsApp to confirm availability, price, and arrange payment and collection. Prices shown are in South African Rand (ZAR) and may change without notice if stock or condition changes. Collection/handover is arranged directly between the parties; take reasonable precautions for your own safety when meeting to complete a sale, the same as you would for any in-person transaction.
4. Condition, "as-is" sale & warranty
All stock is pre-owned. Listings describe the specific, individually-graded condition of that unit at the time it was checked - items are sold on that basis, and no condition or functionality beyond what is stated in the listing and accompanying sale agreement is implied or guaranteed. For units sold directly by EzeePC, the sale agreement provided at the time of purchase sets out exactly what was tested and what's included, and is the governing document for that sale. Please read a listing's condition notes and ask questions on WhatsApp before buying if anything is unclear - once a sale is agreed, it is on the basis of the condition described.
5. Accounts
You can register an account to list items or manage your activity on the site. You're responsible for keeping your login details secure and for anything done under your account. We may suspend or remove an account, or take down a listing, that we reasonably believe is fraudulent, misleading, or in breach of these terms, without notice.
6. Your content
If you post a listing, message, review or other content on this site ("Your Content"), you confirm it's your own, accurate, and doesn't infringe anyone else's rights. You grant EzeePC a non-exclusive, worldwide licence to display, reproduce and distribute Your Content for the purpose of operating and promoting the site (including on our social media and marketing). We may remove any content that breaches these terms at our discretion.
7. Acceptable use
Don't use this site to post false or misleading listings, impersonate someone else, scrape or resell our content, attempt to circumvent or interfere with the site's normal operation, or use it for any unlawful purpose.
8. Your information
We collect the information you give us when you register, contact us, or subscribe to our newsletter (such as your name, email and, where relevant, phone number) to run the site, respond to you, and send updates you've asked for. You can unsubscribe from the newsletter at any time using the link in any newsletter email. We don't sell your personal information to third parties.
9. Limitation of liability
We do our best to describe every listing accurately and to grade fairly, but to the maximum extent permitted by South African law, EzeePC is not liable for indirect, incidental or consequential loss arising from your use of the site, a purchase made through it, or a transaction with another user. Nothing in these terms limits any right you have under the Consumer Protection Act, 2008, or other South African law that cannot lawfully be excluded.
10. Indemnity
You agree to hold EzeePC harmless from any claim or loss arising from your breach of these terms, your use of the site, or a transaction you enter into with another user - except where that claim or loss was directly caused by EzeePC's own negligence or breach of these terms.
11. General
If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with any sale agreement issued for a specific purchase, are the entire agreement between you and EzeePC regarding that purchase. We're not liable for delays or failures caused by circumstances beyond our reasonable control. These terms are governed by the law of South Africa, and any dispute will be handled in the courts of South Africa having jurisdiction over Cape Town, unless the Consumer Protection Act or other applicable law gives you a right to a different forum.
12. Changes to these terms
We may update this page from time to time as the site or the law changes. The date at the top reflects the last update; continued use of the site after a change means you accept the updated terms.
